EXAMINATION OF THE CURRENT FUNCTIONS OF THE JUVENILE JUSTICE SYSTEM BY A MEMBER OF THE US CONGRESS, STRESSING AREAS WHERE LEGISLATIVE REFORM IS NEEDED AND RECOMMENDING DEVELOPMENT OF A UNIFORM JUVENILE CODE.
Abstract
THE AUTHOR CITES SUCH INADEQUACIES AS THE MISPLACEMENT OF EMPHASIS ON PROCEDURAL RATHER THAN REHABILITATIVE ISSUES IN THE SYSTEM, JUVENILE COURT FAILURE TO CONVERT THE PROMISE OF TREATMENT INTO THE RIGHT TO TREATMENT, AND LEGISLATIVE INACTION IN IMPLEMENTING THE RIGHT TO TREATMENT. ALSO STUDIED ARE NEGLECT OF THE JUVENILE COURTS, FAILURE TO ENACT PROMISED PINS (PERSONS IN NEED OF SUPERVISION) LEGISLATION, POLITICAL AND PUBLIC APATHY, AND RACIST AND CLASS VALUES IN THE JUVENILE JUSTICE SYSTEM. THE PROBLEMS OF PROBATIONARY PLACEMENT AND ALTERNATIVE COMMUNITY BASED TREATMENT CENTERS OR PUBLICLY OR PRIVATELY FUNDED FACILITIES ARE ALSO DISCUSSED. A UNIFORM JUVENILE CODE WITH STATEWIDE AND LEGISLATIVE MONITORING DEVICES IS PROPOSED.
