THIS PAPER DISCUSSES THE NATURE AND PROBLEMS OF COMMUNITY TREATMENT OF JUVENILES UNDER THE CHILDREN'S AND YOUNG PERSONS ACT OF 1969 IN THE UNITED KINGDOM.
Abstract
THE AUTHOR TRACES THE BACKGROUND OF THIS CONTROVERSIAL ACT AS IT IS APPLICABLE TO POTENTIAL AND ACTUAL JUVENILE OFFENDERS. ALSO DISCUSSED ARE ITS PRINCIPAL AIMS OF OPTIMIZING PREVENTION AND DIVERSION, CORRECTING THE SOCIAL STIGMAS OF TREATMENT, AND GENERALLY PROVIDING BETTER TREATMENT FOR JUVENILES. THE ACT ADVOCATES USING FLEXIBLE RESOURCES AND INDIVIDUALIZED INSTRUCTORS THAT DE-EMPHASIZE PROFESSIONALISM AND MAKE MAXIMUM USE OF VOLUNTEERS FROM PARTICULAR COMMUNITIES. THE AUTHOR DISCUSSES THE USE OF ORDINARY EDUCATIONAL AND RECREATIONAL FACILITIES AT THE COMMUNITY LEVEL FOR COPING WITH JUVENILES UNDER SUPERVISION ORDERS OF THE JUVENILE COURT. HE ALSO IDENTIFIES THE DISCRETIONARY POWERS OF THE SUPERVISORY OFFICER AND THE TIMELY MATCHING OF SUPERVISORY OFFICERS WITH THE SUPERVISED JUVENILES AS THE KEY PROBLEMS OF THE ACT.
