This student textbook discusses each major area of the law of evidence, based upon common law rules, the 'Federal Rules of Evidence,' and the 'California Evidence Code.'
Abstract
Following a discussion of the nature and kinds of evidence, the procedure for admitting or excluding evidence is examined under the topics of rulings on evidence admissibility in trial court, appellate review of trial court rulings on admissibility, and preliminary determinations regarding admissibility. The chapter on evidence relevancy considers definitions of relevancy and materiality, limits on admissibility of relevant evidence, and evidence affected by extrinsic policies. The general nature of the hearsay rule and its exceptions are also treated, followed by an examination of the following areas bearing on witness evidence: competency to testify, opinion evidence, form of examination, impeachment and rehabilitation, and privilege. The rules concerning demonstrative and scientific evidence are examined as well, along with documentary evidence, burdens and effect of evidence, and judicial notice. Review questions and answers are provided at the text's conclusion. Tables are provided for citations to Federal rules and the California Evidence Code and judicial cases.
