Abstract
THE WORK IS DESIGNED FOR THE UNDERGRADUATE STUDENT OF CRIMINAL JUSTICE, ALTHOUGH LAW SCHOOL STUDENTS WILL ALSO FIND IT USEFUL. EXAMPLES ARE USED WHENEVER APPROPRIATE, SO AS TO ILLUSTRATE ABSTRACT LEGAL CONCEPTS WITH RECOGNIZABLE FACT SITUATIONS. LEADING CASES AND ESSENTIAL CITATIONS ARE PROVIDED. THE FIRST 10 CHAPTERS, WHICH FOCUS ON CRIMINAL PROCEDURE, DISCUSS FEDERAL AND STATE JURISDICTION, PROCEDURE PRIOR TO TRIAL, TRIAL PROCEDURES, WHEN PROBABLE CAUSE IS REQUIRED, 'STOP AND FRISK,' TYPES OF SEARCH OR SEIZURE, EXCEPTIONS TO THE EXCLUSIONARY RULE, ADMISSIONS AND CONFESSIONS, AND THE DEFENDANT'S CONSTITUTIONAL RIGHTS. EVIDENCE TOPICS INCLUDE KINDS OF EVIDENCE, BASIC REQUIREMENTS FOR ADMISSIBILITY, AND INTRODUCTION OF EVIDENCE. DISCUSSION OF WITNESSES AND PRIVILEGED COMMUNICATIONS FOCUSES ON COMPETENCY TO TESTIFY, METHOD AND SCOPE OF EXAMINING WITNESSES, OPINION TESTIMONY, IMPEACHMENT OF WITNESSES, AND PRIVILEGED COMMUNICATIONS. NEXT EXAMINED IS THE HEARSAY RULE AND ITS EXCEPTIONS, FOLLOWED BY A REVIEW OF THE USE OF DEMONSTRATIVE, SCIENTIFIC, AND DOCUMENTARY EVIDENCE AT TRIAL. FINALLY, AN EXPLANATION OF JUDICIAL NOTICE, BURDEN OF PROOF, AND PRESUMPTIONS CONCLUDES THE BOOK. EACH CHAPTER ENDS WITH A SUMMARY. (LWM)
