This is a 1997 overview of Montana law pertinent to the privacy and security of criminal justice information.
Abstract

The Montana Criminal Justice Information Act of 1979 requires the photographing and fingerprinting of persons under certain circumstances, ensures the accuracy and completeness of criminal history information, and establishes the protection of individual privacy in criminal justice information recordkeeping. Part 1 of the law contains general provisions, and Part 2 contains provisions pertinent to information collection and processing. Sections of Part 2 address the scope of authority to collect, process, and preserve criminal justice information; the collection and processing of photographs and fingerprints; the form, content, and limits on use of records; record preservation; procedures to ensure the accuracy of criminal history records; the inspection or transfer of criminal history records; and challenge to and correction of information. Part 3 contains sections on information dissemination, including the dissemination of confidential criminal justice information, agreements as to access to information, and the dissemination of copied or inspected records. Part 4 of the law, which addresses system security, mandates security procedure, with provisions for automated equipment, computer programming, manual equipment, and personnel.
