This book was written to help people cope with the shock and helplessness of arrest and to deal effectively with procedures and questions associated with arrest.
Abstract
A discussion of the nature of arrest procedures in Texas examines arrest warrants, searches, damage to a house during warrant execution, effects of illegal arrest, and prosecuting the police for illegal activities. Specific types of arrest are reviewed, including drug and alcohol, weapons-related, mental health, and juvenile arrests. Special types of arrest are also considered, such as traffic offenses, prostitution, domestic violence, and hunting and fishing violations. Specific circumstances related to arrest involve old warrants, out-of-country and out-of-state warrants, vehicle impounding, mistaken identity, arrest for mere presence, arrest of probationers and parolees, and arrest of military personnel. Arrest procedures are discussed in terms of Miranda, how to react to arrest, effects of arrest on children, the booking process, phone calls in jail, and the process of arraignment. The book also covers release from jail (bonding procedures and application for writ of habeas corpus), the legal process, how to survive in jail, and what the family has to face. A flow chart of the Texas criminal justice system is included.
