EXAMINES THE CONSTITUTIONALITY OF WARRANTLESS SEARCHES BY AIRLINE PERSONNEL TO DETER HIJACKING.
Abstract
IT IS HELP THAT WARRANTLESS INTRUSIONS INTO PRIVACY INVOLVED IN THE BOARDING PROCESS MUST BE RELATED TO EFFORTS TO PREVENT HIJACKINGS. SEARCHES FOR MINIATURIZED EXPLOSIVES ARE DEEMED UNWARRANTED AND UNNECESSARY. IF A SEARCH SHOULD BE NEEDED DUE TO ACTIVATION OF THE MAGNOMETER, IT IS RECOMMENDED THAT IT BE LIMITED TO A PAT-DOWN SEARCH OF THE OUTER CLOTHING OF THE SYSPECT. A UNITED STATES SUPREME COURT RULING ON THE POWERS AND LIMITATIONS OF OFFICERS IN AN AIRPORT SEARCHED IS BELIEVED IMPERATIVE. STANDARDS TO BE APPLIED NATIONWIDE ARE URGED.
