This article represents an historical and sociological examination of the organized crime phenomenon with particular attention being paid to the recent development of legal concepts and tools to fight it.
Abstract
The author examines the emergence of a new type of Mafia in Italy and on the international scene and the lag between the appearance of such phenomenon and the enactment of appropriate laws to control and combat it. The new Mafia which operates in markedly different ways and areas than the traditional one, also selects new victims, people that previously would have been considered out of reach. These new victims are representatives of the judicial, legislative, and executive branches of government, professionals, union leaders, and academics that attempt to eradicate organized crime or that are perceived as obstacles to the achievement of its goals.
