THIS BRIEF PAPER ATTEMPTS TO SET FORTH THE GENERAL PRINCIPLES OF LAW GOVERNING THE RIGHTS OF THE CONFINED. THE SPECIFIC ISSUE ADDRESSED IS THE USE OF NON-MEDICAL PERSONNEL IN PRISONS.
Abstract
THE TWO QUESTIONS RAISED ARE 1) CAN AN UNLICENSED PERSON PERFORM MEDICAL OR NURSING FUNCTIONS WITHOUT VIOLATING STATE PROSCRIPTIONS AGAINST THE UNLICENSED PRACTICE OF MEDICINE? AND 2) IS THE SUBJECTION OF PRISONERS TO MEDICALLY UNSKILLED PERSONNEL A FORM OF CRUEL AND UNUSUAL PUNISHMENT? RELEVANT COURT DECISIONS AND STATUTES ARE EXAMINED.
