This paper discusses the need for training of neutral arbitrators, mediators, and factfinders for labor disputes and describes extant and proposed training programs.
Abstract
The role of the National Academy of Arbitrators (NAA) in training is reviewed, as are the characteristics of the NAA membership. Descriptions are provided of seven training programs, along with such proposed approaches as arbitration fellowships, arbitrators in residence, mentor-intern programs, and the use of new arbitrators as hearing officers under the supervision of experienced arbitrators. Three training programs for public-sector neutrals -- the University of California-Los Angeles program, the Berkley dispute settlement training program, and the Western New York arbitrator development program -- are described with respect to their objectives, selection of trainees, costs, methodology, accomplishments, and evaluation and followup activities. Department of Labor training activities also are delineated, and a training program targeted for females and minorities is described. Finally, recommendations for training programs are presented, and a proposed national, comprehensive neutral training program is described. 68 references and 3 discussion questions.
