This book contains role plays, problems, and additional materials used in teaching law students about mediation.
Abstract
It is intended for use with an accompanying student's guide that focuses on the critical legal, ethical, and policy issues that have arisen with the growth in the use of mediation in the United States during the past two decades. An introduction gives suggestions for using the manual in differing course formats, including a mediation segment of a law course, a mediation issues seminar and clinical course, and a mediation seminar. Instructions are also given on the use of the role plays. The eight role plays and two problems present a variety of disputes, with specific emphases on confidentiality, power imbalance, illegal conduct, the use of intimidating negotiating techniques, and unrealistic or unfair agreements and payments to avoid criminal prosecution. For each role play, general guidelines, information for both disputants, and instructions for each disputant are provided. Three simulation exercises involving empathic listening are also presented.
