This special issue focuses on the legal and medical issues surrounding employee drug testing.
Abstract
Special emphasis is given to constitutional issues such as search and seizure and the protections provided to government employees under the fourteenth amendment. The role and responsibility of clinical testing laboratories in ensuring the reliability of test results is discussed, and Executive Order 12,564, designed to bring about a drug-free Federal workplace, is assessed. Problems confronting managers charged with implementing drug abuse testing in the workplace are explored, and the liabilities accruing to private employers who fail to test employees for drug abuse are detailed. The drug-testing concerns of labor unions are discussed, with special emphasis on including drug testing programs within the collective bargaining agreement. The special issue also includes an outline of case law on constitutional issues arising out of employee drug testing, and a bibliography of scholarly publications that treat issues, concerns, and policies involved in mandatory drug testing.
