Transfer of supervision of foreign offenders is discussed.
Abstract
A draft model agreement is included in this report which addresses the balancing of concerns of the various member states including victim's rights, reintegration of offenders into their communities, cooperation regarding the revocation of a suspended sentence or a conditional release, and the mutual enforcement of court decisions after revocation. Also addressed in the draft model agreement are the principles of national sovereignty, dual criminality, double jeopardy, adaptation, i.e., adapting the conditions imposed in the sentencing State to make them compatible with the administering state's legislation, and nonaggravation of the offender's situation as a result of the transfer. The draft model agreement is based on the results of the International Expert Meeting on United Nations and Law held in 1987.
