THE FOUR GROUNDS FOR REMOVAL OF JUDICIAL OFFICERS IN THE STATE OF NEW JERSEY ARE PRESENTED AND THE QUESTION AS TO WHETHER A JUDGE MUST BE REMOVED IF ONE OF THE GROUNDS FOR REMOVAL AS FACTUALLY SUPPORTED IS DISCUSSED.
Abstract
JUDICIAL DECISIONS ARE CITED TO CLARIFY AND DEFEND POSITIONS HELD BY THE AUTHOR. THE GROUNDS FOR REMOVAL FROM OFFICE ARE INCOMPETENCE, MISCONDUCT IN OFFICE, WILLFUL NEGLECT OF DUTY, AND OTHER CONDUCT EVIDENCING UNFITNESS FOR JUDICIAL OFFICE. THE AUTHOR CONCLUDES THAT THE N.J. STATUTES SEEM TO PROVIDE FAIR AND ADEQUATE STANDARDS TO NOTIFY JUDICIAL OFFICERS IN THE AREAS OF PROHIBITED CONDUCT, AND TO GUIDE THE COURT IN DECIDING WHETHER CERTAIN CONDUCT CONSTITUTES THE RARE OCCASION WHERE REMOVAL MAY BE APPROPRIATE.
