RESULTS OF SURVEY OF THE NATURE AND EXTENT OF MEDICAL RESEARCH IN STATE CORRECTIONAL FACILITIES AND THE LAWS, POLICIES AND OTHER RESTRICTIONS ON THE CONDUCT OF SUCH RESEARCH ON PRISONERS.
Abstract
NINE CATEGORIES OF STATE WERE IDENTIFIED - RANGING FROM THOSE WITH LAWS PROHIBITING THE USE OF PRISONERS IN MEDICAL RESEARCH TO THOSE WHO REPORT MEDICAL RESEARCH AS GOING ON IN ONE OR MORE OF THEIR FACILITIES, EIGHT STATES DID NOT RESPOND TO THE SURVEY. THE VARIOUS FORMS WHICH EXPLICT PROHIBITIONS ON MEDICAL RESEARCH HAVE TAKEN IN EACH STATE ARE OUTLINED. ALSO PRESENTED IS INFORMATION ON THE MEDICAL RESEARCH GOING ON IN THOSE STATES REPORTING SUCH RESEARCH. THE AUTHORS CONCLUDE THAT IN AT LEAST TWO THIRDS OF THE STATES, NO MEDICAL RESEARCH IS BEING CONDUCTED IN STATE CORRECTIONAL FACILITIES, AND SEVERAL STATES WHICH HAD PREVIOUSLY CONDUCTED RESEARCH IN STATE PRISONS HAVE HALTED THEIR PROGRAMS. HOWEVER, ONLY ELEVEN STATES REPORTED SOME FORM OF FORMAL PROHIBITION ON THE CONDUCT OF RESEARCH USING PRISONERS, WITH PRISONERS HAVING THE PROTECTION OF LAW AGAINST EXPERIMENTATION IN ONLY ABOUT THREE.
