OPINIONS INDICATIVE OF DEVELOPMENTS IN STATE SUBSTANTIVE AND CONSTITUTIONAL LAW ARE SUMMARIZED IN AN OUTLINE OF STATE APPELLATE DECISIONS IN THE CRIMINAL AND CIVIL FIELDS.
Abstract
MANY OF THE CASES CITED WERE SELECTED FROM OPINIONS SUBMITTED BY THE CHIEF JUSTICES OF STATE APPELLATE COURTS. CASE ANNOTATIONS IN LAW REVIEWS, LEGAL SERVICES, AND OTHER SOURCES PUBLISHED IN 1976-1977 WERE ALSO CONSULTED. CUTOFF DATE FOR SCREENING CASES WAS MAY 1, 1977. THE CRITERIA FOR INCLUSION IN THE OUTLINE WERE SIGNIFICANCE BEYOND A GIVEN STATE JURISDICTION; INDICATION OF A LEGAL TREND IN AN AREA OF DEVELOPING OR EMERGING LAW; ADOPTION OF AN INTERPRETATION BASED ON A STATE'S OWN CONSTITUTION THAT AFFORDS MORE PROTECTION THAN INTERPRETATIONS OF THE FEDERAL CONSTITUTION BY THE U.S. SUPREME COURT; DEFINITION OR CLARIFICATION OF THE FUNCTIONS, CONDUCT, AND RESPONSIBILITIES OF THE JUDICIARY; AND/OR RELEVANCE TO THE UNDERSTANDING OF NEW LEGAL DEVELOPMENTS. THE TABLE OF CONTENTS IS DIVIDED INTO THE FOLLOWING SUBJECT AREAS: ADMINISTRATIVE LAW; ATTORNEYS; BANKS AND BANKING; CIVIL PROCEDURE AND JURISDICTION; CIVIL RIGHTS; CONSTITUTIONAL LAW; CONTRACTS AND COMMERCIAL LAW; CORPORATIONS; COURTS; CRIMINAL LAW AND PROCEDURE; DOMESTIC RELATIONS; ELECTIONS; ENVIRONMENT; EQUITY; EVIDENCE; INSURANCE; JUDGES; JURY INSTRUCTION; JUVENILES; LABOR; LANDLORD-TENANT; LIMITATION OF ACTIONS; LOCAL GOVERNMENT; PROPERTY; TORTS; UNEMPLOYMENT COMPENSATION; WILLS; AND WORKMAN'S COMPENSATION. MANY OF THE SUBJECT AREAS ARE SUBDIVIDED. STATE AND SUBJECT INDEXES ARE PROVIDED. (LKM)
