This report surveys statutory and judicial developments for 1980 in public employment dispute settlement at Federal, State, and local levels in the United States and Canada.
Abstract
Section 1, a state-by-state summary of legislation enacted during 1980, notes that only 12 States passed new laws or amended existing ones affecting public employees and these primarily concerned arbitration and impasse resolution procedures. Section 2 on the Federal sector highlights activities of the Federal Labor Relations Authority and the Federal Service Impasses Panel, as well as some key court cases involving the Postal Service. Also covered are the Foreign Service Act and the General Accounting Office Personnel Act of 1980. Section 3 presents an analysis of dispute resolution in Canada and reports on developments in Ontario and legislation covering Federal public employees. Section 4, a review of relevant judicial cases, addresses challenges to the constitutionality of collective bargaining laws and practices, interest arbitration, grievance arbitration, the image offense (or grievances filed against an employer who tries to regulate a public employee's lifestyle), and applications of the Speilberg-Collyer doctrine to the public sector.
