Following an examination of the historical context of the second amendment right to keep and bear arms, this book examines varying interpretations of the right and the controversy surrounding it.
Abstract
Interpretation by writers on both sides of the controversy are examined, with particular emphasis on individual versus collective analyses. Lower court opinions reflecting both individual and collective analyses and related constitutional concerns (e.g., due process, self-incrimination) are provided. Also examined are U.S. Supreme Court decisions that have held that the second amendment limits Federal, but not State, powers. A summary of the controversy examines the issue with respect to firearm-related violence and crime and presents some scholarly alternatives to the individual/collective rights controversy. Appendixes provide listings of State constitutional provisions dealing with the right and selected court cases. A bibliography contains approximately 180 references.
