The juvenile codes of all 50 States and the District of Columbia are reviewed to determine if they have specific legislation authorizing restitution programs.
Abstract
The survey, conducted in 1980, shows that 31 States have specific provisions authorizing restitution programs for juveniles. Washington, D.C. and 18 States have general probation statutes which would allow the court to include restitution orders as part of the conditions of probation. The exact language used in the statutes of the 18 States and the District of Columbia varies, but the statutes generally give the court wide discretion in setting the terms and conditions of probation, without specifically mentioning restitution. The relevant sections in the codes of each of the States and the District of Columbia are presented. The narrative summary lists the 31 States specifically authorizing restitution, as well as the 18 States that have general probation statutes which would permit restitution orders.
