This report of the fifth session of the United Nations Ad Hoc Committee on the Elaboration of a Convention Against Transnational Organized Crime encompasses informal consultations on the draft Protocol Against the Smuggling of Migrants by Land, Air, and Sea, Supplementing the United Nations Convention Against Transnational Organized Crime, as well as informal consultations on the revised draft Protocol To Prevent, Suppress, and Punish Trafficking in Persons, Especially Women and Children, Supplementing the United Nations Convention Against Transnational Organized Crime.
Abstract
At the informal consultations on the draft Protocol Against the Smuggling of Migrants by Land, Air, and Sea, Supplementing the United Nations Convention Against Transnational Organized Crime (held October 4-6, 1999), the Ad Hoc Committee discussed Articles 2-4 of the revised version. These articles deal with definitions, purpose, and criminalization. Informal consultations on the revised draft Protocol To Prevent, Suppress, and Punish Trafficking in Persons, Especially Women and Children, Supplementing the United Nations Convention Against Transnational Organized Crime (held October 6-8, 1999) addressed Articles 1 and 2. The discussions focused on the wording of "purpose," the scope of application, and definitions. The discussion of definitions addressed "sexual exploitation" and "forced labor," as well as suggestions for other terms. The majority supported recommending to the plenary the use of a proposal by Belgium, Poland, and the United States to restructure the draft Protocol as a basis for further discussion of the draft Protocol.
