This report presents the proposal of the Law Reform Commission of Canada for the code of criminal procedure relating to police powers regarding searches and related activities.
Abstract
The code is intended to be simple, consistent, coherent, and guided by the principles of fairness, efficiency, clarity, restraint, accountability, participation, and protection of society. Individual sections address police powers applicable to search and seizure, the gathering of forensic evidence, and the testing of persons for impaired driving. Other sections cover electronic surveillance, the disposition of seized objects, and privilege in relation to seized objects. The text of each provision of the proposed code is accompanied by explanatory comments. Footnotes
