THE HISTORY OF CAPITAL PUNISHMENT IN THE UNITED STATES IS BRIEFLY REVIEWED - PROBLEMS ARISING FROM AND POSSIBLE SOLUTIONS TO RECENT SUPREME COURT DECISIONS REGARDING CAPITAL PUNISHMENT ARE DISCUSSED.
Abstract
AS THE AUTHOR SEES IT, THERE ARE THREE POSSIBLE SOLUTIONS, TWO OF WHICH ARE UNCONSTITUTIONAL. THEY ARE MANDATORY CAPITAL PUNISHMENT AND STRICT GUIDELINES LISTING DETAILED AGGRAVATING AND MITIGATING CIRCUMSTANCES ON INDIVIDUAL DETERMINATIONS OF CAPITAL PUNISHMENT. THE ONLY VIABLE ALTERNATIVE IS ABOLITION.
