THE AUTHOR CONCLUDES THAT MOST CENSORSHIP OF INMATE MAIL CAN NO LONGER BE JUSTIFIED BEACUSE CONSTITUTIONAL CONSIDERATIONS OUTWEIGH THE LEGITIMATE CONCERNS OF THE INSTITUTION FOR SECURITY IN ALMOST ALL CIRCUMSTANCES.
Abstract
HE BASES THIS CONCLUSION ON AN EXAMINATION OF THE CONSTITUTIONAL ISSUES INVOLVED IN RELATION TO SEVERAL TYPES OF CORRESPONDENCE BETWEEN INMATES AND THE OUTSIDE WORLD, EACH OF WHICH IS DISCUSSED SEPARATELY. CONSIDERED ARE CORRESPONDENCE WITH COURTS AND PUBLIC OFFICIALS, CORRESPONDENCE WITH ATTORNEYS, CORRESPONDENCE WITH THE MEDIA, AND INCOMING MAIL IN GENERAL.
