This volume reviews the moral and philosophical issues in sentencing theory.
Abstract
The book contains current American and British readings on established areas of theory and policy and chapters on new approaches: restorative justice, critical sentencing theory and "law and order." Each chapter includes an introduction designed to put the issues in perspective, materials of particular interest and a bibliography. The book does not discuss the death penalty, on the theory that a civilized state should not have this sanction at all, so there should be no occasion for the courts to have to decide when and why it should be imposed. The readings are presented in nine major categories: (1) Rehabilitation; (2) Deterrence; (3) Incapacitation; (4) Desert; (5) Structuring Sentencing Discretion; (6) Community Punishments; (7) Restorative Justice; (8) External Critiques of Sentencing Theory; and (9) "Law and Order."
