Pretrial release (PTR) programs can provide a cost-effective and more just alternative to the traditional pretrial detention/bail bond system. The text examines two models of justice -- due process and crime control -- and evaluates the need for pretrial release in a contemporary justice model.
Abstract
The history of bail bond and pretrial detention are surveyed, and the philosophy, operations, and legal issues surrounding PTR programs are reviewed. Two case studies illustrate the operation of PTR programs (in Santa Clara County, Calif., and New York City), focusing on the instrument, its development, implementation, screening and decision processes, and its results and impact. A consideration of effectiveness and cost of PTR programs examines failure-to-appear rates, pretrial crime, economic costs and benefits, equal justice, program release rates and speed of operations, and criminal justice system support. One chapter looks at prediction scales and factors affecting program success, emphasizing community ties, criminal offense factors, organization and operations, and notification and supervision. Tables, chapter notes, an index, and about 140 references are supplied. Appendixes contain the Speedy Trial Act of 1974, the Pretrial Services Act of 1982, PTR program release instruments, and PTR forms.
