These regulations explain the purpose and coverage of a Federal law prohibiting most private employers from using any lie detector tests either for pre-employment screening or during the course of employment. The law permits the use of polygraph tests, but no other types of lie-detector tests under limited circumstances and restrictions.
Abstract
Individual sections define the terms used and explain the exclusion for public-sector employees and the exemptions from the law for national security and defense; employers conducting investigations of economic loss or injury; security firms; and employers authorized to manufacture, distribute, or dispense controlled substances. The rights of employees receiving polygraph tests under these exemptions are also detailed. Further sections cover recordkeeping, disclosure, enforcement, and administrative proceedings to be used in cases of alleged violations of the law and regulations.
