This issue summarizes court cases that have claimed police misconduct in the areas of excessive force, deliberate indifference, civil rights, search and seizure, inmate personal security, high-speed chases, and cell death.
Abstract
Cases that claimed police use of excessive force involved a chased biker's loss of a leg, a youth shot and paralyzed by police, attorney fees awarded for prevailing parties, probable cause to arrest for obstruction of justice, and unreasonable use of force. Cases that involved claims of deliberate indifference concerned an attempted suicide that left a detainee in a coma, the death of a detainee who choked on some soap, and the suicide of an inmate in protective custody. Civil rights cases involved a parolee's right to privacy while giving a urine sample, litigation claims after conviction, and malicious prosecution and assault by officers alleged by car accident victims. Cases of claimed search violations concerned a SWAT team's invasion of a home without a warrant and damage to property in a search. Cases that claimed illegal seizures involved property seized under the drug forfeiture law, warrantless search and seizure in the towing of a drug arrestee's car, and municipal liability for the warrantless seizure of a car. Cases that pertained to inmate personal security involved a claim of negligent supervision in the sexual assault of an inmate. A case associated with a high- speed chase focused on search and seizure and the injury of a motorcycle passenger. The case of a cell death pertained to inmate suicide, inadequate medical treatment, and county liability.
