Review and discussion of Pennsylvania's probation and parole laws are provided.
Abstract
The Commission's recommendations include granting the police a general power to arrest without warrant for certain offenses where a police officer has reasonable grounds to suspect that the person has committed or is committing the offense and where an arrest is necessary to, inter alia, establish the identity of the person, obtain or preserve evidence, or preserve the safety or welfare of any person. The Commission also recommends that the police be granted a limited power to demand the name and address of a person in circumstances where a police officer has reasonable grounds to suspect that a person has committed or is committing an indictable offense, of any person in proximity to the scene of the offense, or of a person who the officer has reasonable grounds to suspect is the person named in a warrant or summons. Any person refusing to give his or her name and address when required to do so by an officer or providing a false name and address shall be guilty of a simple offense subject to a monetary penalty. The Commission recommends that the police not be given a general "move-on" power. Appendixes, reproduced from Volume 1 of the series, provide a list of Acts containing police powers current as of July 1992 and those which have since been repealed or significantly amended, the use of arrest and summons by the Queensland Police Service during 1991, and summaries of Volumes 1 and 2. A list of published reports of the Criminal Justice Commission from May 1990 to September 1993, including their availability and prices, is included.
