Pennsylvania has enacted legislation that focuses on the maintenance of criminal history record information (CHRI) and citizen access to public records.
Abstract
Legislation specifies requirements for collecting protected information, ensuring the completeness and accuracy of CHRI, expunging criminal records, maintaining juvenile criminal records, assuring data security, and protecting the individual's right of access and review. Criminal information can be placed in Pennsylvania's criminal justice information system only if the criminal justice agency has reasonable suspicion of criminal activity. In addition, legislation places strict guidelines on the dissemination of CHRI and on protecting data security and confidentiality. Legislation also identifies security requirements for data repositories, outlines procedures related to the individual's right of criminal record access and review, identifies data to be collected as part of criminal identification, and addresses citizen access to public records.
