This text presents a preliminary draft of the reformed penal code of Paraguay, in its entirety, in outlined format and detailed by section; an earlier publication gives more explanation.
Abstract
In contrast to penal codes of the past, this revision redefines the concept of crime in terms of its etiology and the natural inclinations of humankind to build rather than to destroy the environment. Certain crimes are decriminalized, while offering alternative solutions, such as alternative sentencing. International human rights issues were considered, while remaining within the limits of the local constitution. The publication of the draft is meant to stimulate discussion and further revisions to the document. Changes affect the judicial, legal, and social populations of the country; the document seeks to update the code's ideas and language, to open discussion on new perspectives, and to encourage integral thought, encouraging tolerance and creativity with justice.
