The paper determines the number of nonviolent offenders committed and confined to the Virginia Department of Corrections in fiscal year 1981 who were potentially eligible for community diversion based on six objective criteria.

Abstract

A total of 373 case records of inmates committed for a nonviolent offense were reviewed. Approximately 43 percent (160 cases) of the sample were found to be eligible based on 6 criteria: no detainers or pending charges by other jurisdictions exist, the offender has not been convicted within the past 10 years of an offense involving a firearm, the offender has not been adjudged a habitual offender, the offender has been sentenced to a minimum of 3 years, the offender has not been sentenced to an undeterminate sentence under the Youthful Offender Act, and the offender has no history of violent offenses within the past 5 years. It is estimated that 38 to 48 percent of the total number of offenders (2,300) were potentially eligible for diversion. This translates in number of inmates to between 870 to 1,100.
