This chapter contains requirements of the Drug-Free Workplace Act that must be satisfied by persons and organizations seeking contracts or grants from a Federal agency.
Abstract
The requirements of the Act apply to any entity (other than an individual) who is capable of entering into a contract, or being awarded a grant, from the Federal Government. This could include State and local governments, public and private educational institutions, and federally funded research and development centers. There are definitions of an individual, a workplace, an employee, and other terms as they are used in the Act. The chapter also includes: employers' responsibilities for informing employees of the Act's requirements; employees' responsibilities for adhering to those requirements; implications for failure to comply; enforcement procedures; consequences of contractors' failure to meet Act requirements; appeals process and waivers; and how the requirements of the Act relate to other statutory requirements for a drug-free workplace included in other authorization bills.
