AFTER A BRIEF REVIEW OF THE COMMISSION BACKGROUND, THIS ARTICLE SUMMARIZES THE COMMISSION'S FINDINGS ON COURT-AUTHORIZED SURVEILLANCE, CONSENSUAL SURVEILLANCE, PROTECTION OF PRIVACY AND ILLEGAL SURVEILLANCE.
Abstract
THE NATIONAL COMMISSION FOR THE REVIEW OF FEDERAL AND STATE LAWS RELATING TO WIRETAPPING AND ELECTRONIC SURVEILLANCE WAS CREATED TO CONDUCT A COMPREHENSIVE STUDY AND REVIEW OF THE OPERATION OF TITLE III OF THE SAFE STREETS ACT IN THE FIRST SIX YEARS AFTER ITS ENACTMENT. IN CARRYING OUT THIS CONGRESSIONAL MANDATE, THE COMMISSION CONCENTRATED ITS EFFORTS IN THREE PRINCIPAL AREAS: DETERMINING WHETHER COURT-AUTHORIZED ELECTRONIC SURVEILLANCE UNDER THE PROVISION OF TITLE III IS AN EFFECTIVE TOOL IN LAW ENFORCEMENT; WHETHER IT ADEQUATELY MINIMIZES THE INVASION OF THE PRIVACY OF THE INDIVIDUAL; AND WHETHER TITLE III IS EFFECTIVE IN PREVENTING ILLEGAL WIRETAPPING AND BUGGING.
