This paper presents a model policy statement for police departments that will guide them in implementing the Americans with Disabilities Act in providing services to disabled citizens and in hiring and managing disabled personnel.
Abstract
The general policy statement indicates the department is obligated to afford people with disabilities the same access to programs, services, and employment provided to all citizens. This includes, but is not limited to, services such as first responder recognition of the nature and characteristics of various disabilities and appropriate physical and emotional support to people with disabilities who seek to access police services or who come into contact with the police. This general policy statement is followed by definitions. The procedural overview advises that the intent of this policy and procedure is to guide employees in responding to and assisting those people with disabilities with whom they will have the most contact in the performance of their duties and responsibilities. The policy and procedure addresses common police interaction with people with disabilities, including those who are complainants, victims, witnesses, arrestees, members of the community who desire to participate in department-sponsored programs, people seeking information, and uninvolved bystanders. An overview of specific disabilities encompasses visual disabilities; mental, emotional, and psychological disabilities; mental retardation; mobility impairments; invisible disabilities; and speech and hearing disabilities. The responsibilities of officers and the department in servicing disabled persons are indicated. Departmental responsibilities encompass routine and emergency interaction and arrest and incarceration. The policy statement on employment issues applies to the equal treatment of disabled persons in recruitment, screening, hiring, and promotions.
