SIX INDIVIDUAL MODELS FOR REGULATIONS TO GOVERN PENAL INSTITUTION OPERATION ARE PROPOSED FOR INMATE CORRESPONDENCE, DISCIPLINE, INMATE GROOMING AND ATTIRE, SEARCH AND SEIZURE, USE OF FORCE, AND VISITING.
Abstract
THE MODEL RULES AND REGULATIONS IN THIS BOOKLET INTEND TO PROVIDE CORRECTIONAL OFFICIALS WITH UP-TO-DATE, CONSTITUTIONAL PROCEDURES WHICH CAN BE IMPLEMENTED WITHOUT FEAR OF LEGAL CHALLENGE. IN ORDER TO INSURE THEIR CONTINUING LEGAL VIABILITY AND AVOID NEEDLESS LITIGATION, THEY ALSO TAKE INTO ACCOUNT POSSIBLE FUTURE JUDICIAL TRENDS. THEY WERE DRAFTED WITH CONCERN FOR BOTH INSTITUTIONAL SECURITY AND INMATE FAIRNESS. THE MODELS DEAL WITH THE MOST CRUCIAL AREAS OF STAFF-INMATE INTERACTION. FOLLOWING THE PRESENTATION OF EACH MODEL IS A COMMENTARY WHICH EXPLAINS THE REGULATION AND SUPPORTS ITS PROVISIONS WITH CASE LAW, CORRECTIONAL STANDARDS STATE STATUTES, INDIVIDUAL STATE PRACTICES, OR OTHER AUTHORITY. WHERE PERTINENT, A BRIEF DISCUSSION OF THE LAW IS ALSO GIVEN. MATTERS DISCUSSED UNDER EACH OF THE MODEL ISSUES ARE AS FOLLOWS: (1) CORRESPONDENCE--PRIVILEGED AND GENERAL CORRESPONDENCE, PROCEDURES FOLLOWING REMOVAL OF ITEMS FROM INCOMING MAIL, AND COLLECTION AND DISTRIBUTION; (2) DISCIPLINARY PROCEDURES--PROCEDURES FOLLOWING MAJOR AND MINOR OFFENSES AND CRIMINAL MISCONDUCT, AND THE RULEBOOK; (3) GROOMING AND ATTIRE--GROOMING, ATTIRE CODES; (4) SEARCH AND SEIZURE--INSPECTION AND SEARCH OF PRISONER ROOMS AND CELLS, NONINTENSIVE SENSOR, PERSONAL AND BODY SEARCHES, GENERAL SEARCHES, PROCEDURES FOR OBTAINING AUTHORIZATION TO SEARCH, AND PRESERVATION OF EVIDENCE; (5) USE OF FORCE--DEADLY FORCE, NONDEADLY FORCE, AND MECHANICAL RESTRAINTS; (6) VISITATION--SELECTION OF VISITORS, CONDITIONS FOR VISITING, AND PROCEDURE FOR VISITING.
