Abstract
The flow chart diagrams various outcomes resulting from arrest by police for a criminal offense, processing at the police station, caution or referral to the Crown Prosecution Service, and hearing at the Magistrates' Court. The options available at this stage include court bail, acquittal, absolute or conditional discharge, guardianship order, or committal to the Crown Court for trial or sentence. Based on presentence and medical reports, a mentally ill and convicted offender could be imprisoned. At each stage of the criminal justice process, the mentally ill offender is subject to psychiatric testing, treatment, or commitment. The chart lists various provisions of the (British) Mental Health Act 1993 and other relevant legislation.
