To what extent does the marital privilege apply to protect third parties involved in criminal conduct with married individuals? The author takes an actual case in which he was involved and deals with this question.
Abstract
The article centers on the assertion of marital privilege by a convicted spouse before a grand jury. The claim is that the privilege applies, even though she was convicted and further immunized, because questions relating to a third party might indirectly implicate her husband. The author candidly (and as the Assistant United States Attorney involved, obviously) takes the government's side here. He also provides some very valuable practice tips by setting out his strategy and providing us with proposed questions for the recalcitrant witness. (Publisher abstract)
