This text provides background information on constitutional law in relation to managers in public agencies and details the legal responsibilities and limitations of police supervisors in relation to codes of conduct, employment at will, employment discrimination, and other issues.
Abstract
The first chapter emphasizes that the Constitution sets the parameters for all government actions and defines areas of individual liberties that cannot be infringed. The next chapters explain the constitutional limitations on codes of conduct in the areas of vagueness, excessive breadth, and substantive due process and discuss exceptions to the concept of employment at will. They also explain how laws on employment discrimination limit discretion in hiring, promotion, and dismissal decisions and mandate an objective review of all personnel policies and procedures. Further chapters focus on legal issues related to sexual harassment, the Americans with Disabilities Act of 1990, injured employees, the Fair Labor Standards Act, internal affairs procedures, and mistakes made by internal affairs investigators. Other chapters discuss freedom of speech, religious freedom in the workplace, employee drug testing, employee litigation under Section 1983 of 42 U.S.C., failure to protect, and Federal criminal violations.
