Following an introduction that reviews the history, structure, and basic concepts of the 1953 Korean Criminal Code, this book presents an English translation of the code.
Abstract
Part I presents general principles applicable to the code's specific provisions. It discusses the scope of the application of the criminal code and extends the territorial principle of criminal jurisdiction to offenses against Korea's interests committed by aliens outside her territory. It also presents general principles pertaining to crime elements. General principles for punishment encompass the death penalty, penal servitude, imprisonment, deprivation of qualifications, suspension of qualifications, fines, detention, minor fine, and confiscation. Part II of the code consists of 42 chapters and 286 articles. It divides the interests protected against the criminal into three kinds: State interests, social interests, and interests of individuals. New provisions covered under State interests include crimes against the national flag, nonperformance of a munitions contract in war-time, nonfulfillment in war-time of a contract with the government for the supply of necessities of life, organization of criminal groups, impersonation of a public official, and abandonment of official duties. There are no new additions under crimes against social interests except amendment of the rule on adultery and minor changes in punishment. Crimes against the interests of individuals have several new additions, including pandering, infanticide, abandonment of a baby, delivery of a child under the accused's supervision for employment at hard labor, and sexual intercourse under pretence of marriage.
