THIS MANAGEMENT STUDY, DATED DECEMBER 1974, DISCUSSES THREE WAYS IN WHICH STAFF ATTORNEYS COULD BE USED TO INCREASE DECISIONAL OUTPUT BY REDUCING BACKLOGS AND TO ENSURE CAREFUL REVIEW AND SOUND DECISIONS IN EVERY CASE.
Abstract
PLAN A PROVIDES FOR STAFF ATTORNEY ASSISTANCE IN SHAPING ISSUES, TAILORING TRANSCRIPTS, AND PERFECTING CRIMINAL APPEALS. PLAN B PROPOSES THE ADOPTION OF PROCEDURES FOR STAFF ATTORNEY SCREENING, RESEARCH, MEMORANDUM WRITING, AND OPINION DRAFTING. PLAN C WOULD EXPEDITE DECISIONS IN SELECTED CASES BY OMITTING THE TIME TYPICALLY TAKEN FOR BRIEFING AND THE COURT'S DECISIONAL PROCESS AND SUBSTITUTING AN ORAL DISCUSSION WITH THE JUDGES FOLLOWED BY A PROMPT DECISION. PLAN A IS SEEN AS CONFRONTING SUBSTANTIAL DIFFICULTIES OF IMPLEMENTATION BECAUSE OF THE ATTORNEYS' FELT NEED FOR A FULL TRANSCRIPT IN EVERY CASE.
