ESSAY ON THE STATUS OF JUVENILES IN RELATION TO THE CURRENT SOCIAL AND JURIDICAL SYSTEM IN ITALY.
Abstract
THE DEFINITION OF JUVENILES IS A PURELY JURIDICAL ONE, BELONGING TO A SYSTEM OF LEGAL POWERS AND RELATIONSHIPS WHICH, THOUGH DIRECTED IN PRINCIPLE TO THE PROTECTION OF MINORS, DOES NOT FULLY RECOGNIZE THEM AS SUBJECTS OF RIGHTS AND RELEGATES THEM TO A MARGINAL SOCIAL POSITION. BEYOND THIS LEGAL MARGINALITY, THERE IS THE SOCIAL MARGINALITY DETERMINED BY THE EXCLUSION OF THE YOUNG FROM THE ECONOMIC AND PRODUCTIVE SECTORS OF SOCIETY AND FROM THE DECISION MAKING PROCESSES. THUS, THE AUTHOR NOTES THAT RECENT LEGAL REFORMS AIMED AT ALLEVIATING THE MARGINAL CONDITION OF JUVENILES, CONTRADICT THE RIGID SOCIETAL EXCLUSION OF JUVENILES. --IN ITALIAN. SUMMARY IN ENGLISH
