This book examines the effectiveness and deficiencies of judicial intervention in solving the problems of discrimination in the Nation's schools, discrimination because of race, gender, national origin, or intellectual or physical impairment.
Abstract
The authors -- recognized authorities in education law, constitutional law, the judiciary, or other pertinent fields -- present case studies, surveys, and interviews of the lawyers and judges who participated in the leading cases. They analyze critical issues that remain unresolved, such as the battle over racial desegregation that still rages in Yonkers, N.Y. Cases are traced from their beginnings through years of negotiations among the affected parents, lawyers, judges, school boards, and other local agencies. The book analyzes the effectiveness of judicial activism in correcting fundamental abuses of citizens' rights in the educational system. Analyzing the remedies devised by the courts, the book assesses their success or failure as well as the factors contributing to the outcome. Chapter notes, subject index. (Publisher summary modified)
