A BRITISH MEMORANDUM GIVES DETAILED RULES FOR THE CONDUCT OF IDENTIFICATION PARADES, OFFERS ADMINISTRATIVE GUIDELINES, AND CONTAINS FORMS TO BE USED DURING THE PARADE. RULES ON USE OF PHOTOGRAPHS ARE INCLUDED.
Abstract
TO ENSURE THAT THE IDENTIFICATION PARADE (LINEUP) IS FAIR, THE PARADE RULES ARE SET OUT WITH THE WARNING THAT FAILURE TO ABIDE BY THE PROVISIONS MAY RESULT IN THE JUDGE, WHEN SUMMING UP TO THE JURY, COMMENTING ON THE RELIABILITY OF THE EVIDENCE. THE RULES INCLUDE: DIRECTION FOR CIRCUMSTANCES OF THE PARADE, THE RIGHTS OF THE SUSPECT TO HAVE A FRIEND, SOLICITOR, OR PARENT (IF THE SUSPECT IS UNDER 17 YEARS) PRESENT, INFORMATION GIVEN TO WITNESSES ABOUT THE SUSPECT, PROCEDURES TO BE FOLLOWED DURING THE PARADE BY THE INSPECTOR WHO CONDUCTS IT, AND INFORMATION AND REQUIRED FORMS. ADMINISTRATIVE GUIDANCE CONCERNING THE PARADE IS GIVEN BRIEFLY, INCLUDING INSTRUCTIONS FOR TRYING TO IDENTIFY A SUSPECT IN A PARTICULAR NEIGHBORHOOD, PROVIDED THE WITNESS'S ATTENTION IS NOT DIRECTED TO ANY INDIVIDUAL. INCLUDED ARE INSTRUCTIONS TO WITNESSES AND SUSPECTS AND COPIES OF APPROPRIATE FORMS AND COPIES OF POLICE REPORTS ON THE VARIOUS KINDS OF IDENTIFICATION PARADES. USE OF PHOTOGRAPHS, ADMINISTRATIVE GUIDANCE, AND THE NECESSARY FORMS COMPLETE THE MANUAL. (RFC)
