DISCUSSION OF FORCED FEEDING OF INMATES WHO REFUSE TO EAT IN THE LIGHT OF DUTCH LAW REGARDING THE INDIVIDUAL'S RIGHT TO PRIVACY AND OF THE PROVISIONS OF THE TREATY OF ROME WITH RESPECT TO BASIC HUMAN RIGHTS.
Abstract
A DISTINCTION IS MADE BETWEEN ARTIFICIAL FEEDING AGAINST THE INDIVIDUAL'S WILL AND ARTIFICIAL FEEDING BY FORCE. THE DISCUSSION OF THE PRISON DIRECTOR'S AND THE PRISON DOCTOR'S OBLIGATIONS TO THE INDIVIDUAL AND TO THE STATE IS KEPT ON A THEORETICAL LEVEL. NO HARD AND FAST CONCLUSIONS ARE ARRIVED AT WHICH WOULD INDICATE THE CIRCUMSTANCES UNDER WHICH AN INMATE WHO REFUSES TO EAT SHOULD OR SHOULD NOT BE FED ARTIFICIALLY. --IN DTUCH
