This article presents a model HIV policy for probation departments regarding treatment of HIV-infected personnel and probationers. For each group, it discusses the department's policy, rationale, and policy implementation.
Abstract
An HIV policy is warranted for probation departments because of the increasing numbers of offenders with HIV infection and the changes in the demographics of HIV for drug abusers and inner city populations. The proposed policy is based on the assumption that casual transmission is not the route of HIV transmission and that neither probation officers nor court personnel are at risk for HIV infection through the routine performance of duties on their jobs. It addresses topics of discrimination, HIV counseling and testing, confidentiality, education, and services for both personnel and probationers with HIV. The policy prohibits discrimination against persons with HIV infection, discourages HIV mandatory testing, supports confidentiality, and requires participation in HIV education programs. 11 references
