This guide presents current (1982) thinking on the 'common law' of employee relations as established by arbitrators' rulings on grievances presented under union contracts.
Abstract
Although arbitrators do not set binding precedents in their awards and rulings on individual grievances, this volume is based on the observation that rulings on similar issues tend to follow similar patterns. For specific types of employee grievances, this book outlines principles to follow in employer-employee relations as they have emerged from arbitrators' rulings on particular grievances. The format for each grievance category discussed in this volume covers a statement of guidelines for the particular aspect of employee relations based on arbitration rulings. Arbitration cases that have established the guidelines are then outlines. Guidelines pertaining to general issues in employee discharge and discipline focus on just cause for discipline, disciplinary procedures, types of penalties, and proving misconduct. Specific categories of discharge and discipline reviewed include absenteeism, insubordination, and misconduct, with 14 aspects of misconduct considered. Other grievance issues addressed are poor work, seniority and its application, leave of absence, promotions, vacations, holidays, health and welfare plans, management rights, union rights, strikes and lockouts, union security, checkoff (dues collection under union contracts), and wages and hours.
