A SERIES OF RECOMMENDATIONS FOR THE IMPOSITION, ADMINISTRATION, AND ENFORCEMENT OF FINES IS PRESENTED IN THIS WORKING PAPER OF THE LAW REFORM COMMISSION OF CANADA.
Abstract
IN KEEPING WITH THE CURRENT TREND TOWARD REDUCING THE USE OF IMPRISONMENT, THE LAW REFORM COMMISSION PROPOSES THAT FINES SHOULD BE CONSIDERED A VIABLE SENTENCING ALTERNATIVE. PRINCIPLES IN THE IMPOSITION OF FINES ARE FIRST EXAMINED. THE COMMISSION RECOMMENDS THAT JUDGES BE GIVEN THE DISCRETION TO IMPOSE A FINE AS THE SANCTION FOR ANY CRIMINAL CODE OFFENSE, EXCEPT THOSE FOR WHICH A MANDATORY SANCTION IS SPECIFIED. THE ENFORCEMENT OF THE FINES SYSTEM IS THEN DISCUSSED, AND PROCEDURES FOR PAYMENT OF FINES ARE EXAMINED. ALSO CONSIDERED ARE THE PROCEDURES TO BE USED IN THE EVENT OF NON-PAYMENT....DMC
