These two volumes present the background materials used by the Federal Courts Study Committee in its analysis of the role and relationships of the Federal courts; the workload of the courts; and court administration, management, and structure.
Abstract
The background materials consist of working papers and reports of subcommittees of the full committee. Topics covered include the history and development of the Federal court system, caseload growth, judicial adaptation to caseload pressures, the scope of Federal jurisdiction, the functions and structure of the Office of Judicial Impact Assessment, the division of jurisdiction between Federal and State courts, and administrative remedies to current problems. Other topics include consolidation and severance procedures, parole hearings, the role of alternative dispute settlement, scientific and technological disputes, the confidentiality of discovery materials, attorney fee awards, and sentencing guidelines. Further topics include appellate court issues, defender service issues, the management structure of the district courts, Federal criminal jurisdiction, tax conflict resolution, and arbitration.
