CRITICAL ILLUSTRATION OF THE STRUCTURE AND FUNCTIONING OF EXISTING OBSERVATION CENTERS FOR PRISONERS IN ITALY.
Abstract
THE AUTHOR STRESSES THE IMPORTANCE OF THE EXAMINATION OF THE PERSONALITY OF OFFENDERS IN RELATION TO THE INDIVIDUALIZATION OF PUNISMENT AND TREATMENT. THIS EXAMINATION SHOULD BE PART OF THE JUDICIAL PROCESS AND NOT BE RESERVED ONLY TO THE EXECUTION OF THE SENTENCE AS FORESEEN IN THE CURRENT ITALIAN CORRECTIONAL LEGISLATION. EQUITY OF JUDGMENT COULD BE ACHIEVED BY FOLLOWING THE SUGGESTIONS EMERGING FROM THE TENTH INTERNATIONAL CONGRESS OF PENAL LAW RECOMMENDING THE SEPARATION OF THE JUDICIAL PROCESS INTO TWO PHASES: ONE DIRECTED TO THE IDENTIFICATION OF THE CRIMINAL RESPONSIBILITY OF THE ACCUSED AND THE OTHER TO THE DETERMINATION OF THE SANCTION. IN THE SECOND PART OF THE ARTICLE, THE AUTHOR DESCRIBES THE HISTORICAL DEVELOPMENT OF OBSERVATION CENTERS IN ITALY AND THE WAYS AND MECHANISMS ADOPTED BY THE NATIONAL OBSERVATION INSTITUTE OF REBIBBIA-ROME TO EFFECTUATE A COMPLETE EXAMINATION OF THE PERSONALITY OF THE INMATES. THE DISCREPANCY BETWEEN THE COMPLEXITY OF THE DIAGNOSIS EFFORT AND THE TREATMENT STRUCTURES IS CRITICIZED AND A BETTER COORDINATION BETWEEN THE TWO PHASES IS SUGGESTED. --IN ITALIAN
