The Americans with Disabilities Act (ADA) prohibits employers from discriminating against a qualified individual with a disability through job application procedures, hiring, advancement, or discharge of employees as well as employee compensation or job training.
Abstract
There are a number of steps police agencies need to complete in order to achieve compliance with ADA. In terms of applicant selection, agencies should identify the essential functions of the position; develop selection criteria; redesign the selection process with regard to vacancy notices, applications, psychological examinations, physical agility tests, polygraph and drug tests, and background investigations; draft conditional offer of employment letters; and implement training. Police management may have to modify general agency practices dealing with storage of medical information, fitness for duty examinations, reassignment, and employee benefits.
